California’s Lemon Law

Lemon laws vary from state to state, but it’s essential that you are familiar with your state’s lemon laws. Keep reading to find out what a lemon is and how to remedy your situation if you are a lemon vehicle owner.

What Is a Lemon?

A lemon is a vehicle that has severe manufacturing defects that make it unsafe to drive and beyond repair—even for the manufacturer. Malfunctions that render a vehicle a lemon include issues with brakes, transmission, engine, and more.

California’s Lemon Law Coverage

Coverage under California’s Lemon Law protects vehicles that are both new and used that came with the manufacturer’s new vehicle warranty upon purchase. Vehicles included under the coverage of this law include cars, SUVs, trucks, vans, and more.

Lemon Vehicle Remedies

California’s Lemon Law allows for two redemption options: replacement of the vehicle or a refund of the purchase price.

Prior to exercising one of these two options, California’s Lemon Law dictates that a vehicle qualifies for remedy if the manufacturer—or dealer the vehicle was purchased from—is unable to fix the warranty defect after a reasonable number of attempts.

Although the law doesn’t specify the number of attempts required to fix the issue, the guidelines state that remedy may be pursued if the vehicle has been in the shop for the warranty defect, even if not consecutively, for 30 days. Remedy may also be sought if driving the car would result in significant injury or death after two unsuccessful repair attempts have been made.
